109學年度第1學期東吳大學法律研究所「科技法律組-科技法律總論」期中報告規定

 

1. 每個題目限由一組同學撰寫，每組由二至三名同學組成。請參考「東吳大學科技法律組-科技法律總論:109學年指定參考資料」並擇定一份。每個題目限由一組同學撰寫，若有重複者，請班代進行協調，後續會進行報告次序之重新排序。選題請在10月01日前定案

 

2.10月29日起，分三至四梯次(11月12日、11月26日…)，依排定日期，各組推派一名報告人代表於上課時提出報告，以「指定參考資料」內容為主，期中報告至少3至4千字。

 

3.期中報告請說明：（1）指定參考資料內容完整介紹（2）期末報告預定之題目與研究範圍（3）想要解決的問題以及預期結果、（4）已經蒐集資料。

 

4. 每組口頭報告時間為15到20分鐘，請同組一名同學負責計時，

時間到請報告人停止報告。

 

5. 報告封面請述明：題目、組別、組員名稱、學號。

6. 報告當日請提交一份紙本報告與簡報。

 

7.由老師就報告進行講評，作為期末報告之參考。

三、教學目標 Objectives
希望學生能從法律面瞭解當前科技發展對於政府管制政策、產業發展以及社會所造成的衝擊。透過全面性的介紹科技創新與研發引發的法律爭議，以及如何經由管理制度來有效管理科技的產出，以及科技所造成的衝擊。從現有產業推動的實例，進行現況的探討。期能激發學生對於科技法律研究的興趣，並奠定自我進行科技法律議題研究的基礎。
The course from the current legal framework to understand the impact of technological development for government regulatory policies, industrial development and social caused. Legal disputes through the introduction of technological innovation and comprehensive research and development initiated and how to effectively manage via the management system of science and technology outputs, as well as science and technology caused by the impact. From existing industry-driven examples, discuss the status. For students to stimulate interest in the study of science and technology law, and to lay the foundation for self-study of the question that science and technology law.
四、課程進度 Course Description
●整體敘述 Overall Description 希望透過本門課課程，瞭解目前我國因應產業創新與升級的法律要求，以及企業面對科技進步所帶來的法律挑戰，從製造業科技轉向文化創意的法律課題等。因應近年來通過多項重要法律，例如產業創新條例、文化創意發展法、個人資料保護法，如何在上述法律實證法律對於科技發展與科技市場的影響。其次，如何瞭解透過有效的管理制度來有效管理科技的產出（如智財權），以及科技所造成的衝擊（如個資外洩等），希望能說明新數位科技應用引發之智慧財產權問題、企業建置智慧財產管理制度計畫，以及個人資料保護與管理制度等。 另一方面，從目前我國實際推動「六大新興產業」諸如生物科技、綠色能源、文化創意等新興產業，以及「四大智慧產業」諸如雲端產業與發明專利化等，將介紹國際間推動產業化發展之法制政策，以及我國目前的法制因應措施。同時因應數位匯流發展方案(2010-2015年)的提出，介紹數位匯流法制與垃圾郵件的管制法律問題，以及網際網路犯罪問題、電子商務法律課題進行探討。
